In 1852, daughter Jane Nesmith, precipitated a lawsuit in Chancery Court at Kingston, Roane Co, TN, that brought about a court settlement of the Elias Roberts estate in 1856. Phoebe Roberts had an illegitimate daughter before she m. John Nesmith. This was the Susan Roberts, who m. William H. Burns and whose orphans were mentioned in the settlement of the Elias Roberts estate.
