At Aberdeen the Second day of March in the year One Thousand Eight Hundred Ten in the presence of Arthur Dingwall Fordyce of Culsh Doctor of Laws Commissary compeared Alexander Smith Advocate in Aberdeen as ???? He gave in the before written Testament desiring the same might be insert and registered in the Commissary Court Books of Aberdeen in terms of the Act of Parlament 44th George III Capt 90th and 40Th George III Capt 149th which request the commissary foresaid finding reasonable ordained the same to be done accordingly of which Testament the tenor following viz. I Peter Divorty in Midmill in the parish of Kintore taking to my serous consideration that I am liable to Death and not knowing when that shall happen have thought fit to order my worldly affairs in my lifetime for preventing disputes after my decease. And therefore I have made constitued and ordained Likeas by these presents I make constitute and ordain William Dovorty my Eldest son, my sole Executor and sole Intromitter with my Hail goods and gear debts or sums of money that shall be owing me or pertain to me at the time of my death and discharges and aquittances to grant, decreets and sentences to obtain and in general every thing to do that to the office of Executry doth belong - and I appoint my said executro to defray my funeral charges and to pay all my just and lawful Debts - And my Will is that my hail Subject and Effects be divided among and between my wife Jean Sinclair and my children viz William, Mary, Peter, Margaret, James, George and Alexander share and share alike. And as my subject cannot be convert into Cash without loss, when any hsare is demanded my will is that two honest men be chosen, one by my Executor and another by the person demanding his or her share of my subject, and that the sentence of the said honest men shall be final in all points respecting the amount of the share, the time of payment and the age of the person demanding a share. And I herby recommend my Brother William Divorty in Mill of Birsack and William Tait in Crichie as proper persons to be consulted with on the above matters and failing them any other two mentioned as above. And I hereby declare this to be my Last Will and Testament revoking all former made or pretended to be made thereto I constitute my ???? in testmony thereof. I have subscribed these presents wrote upon this and the preceding page by Mr John Shand Muir of Kintore at Midmill this Twenty-seventh day of January One Thousand Eight Hundred and Seven years before witnesses the said Mr. Shand writer hereof and George Angus crofter in Midmill.
