Will of Nicholas Gassaway; Anne Arundel County Wills, original will G29, Hall of Records, Annapolis, Maryland:
In the name of God Amen, I Nicholas Gassaway of Queen Caroline Parish in Ann Arundel County, Being very Sick and weak in Body, But of Perfect mind & Memory, thanks be given unto God, Therefore Calling unto mind the mortality of my Body, & knowing that it is appointed for all men once to die, do make & ordain this my last will & testament, that is to say, Principally & first of all, I give and Recommend my Soul into the Hands of Almighty God that gave it, & my Body I Recommend to the earth, to be buried in a Descent Christian manner, Nothing Doubting but at the General Resurrection, I shall Receive the same again, by the mighty Power of God, and as to the worldly Estate where with it hath Pleased God to bless me in this life, I dispose of the same in the following manner.---
Item I Give & Bequeath to my deceased Daughter Ann Pierpoints Heirs Samuel Peirpoint &c. one shilling currant money, to my Daughter Elizabeth Selman one shilling money, to my Daughter Susannah Mansill one shilling currant money, & to my son Nicholas Gassaway one shilling currant money.
Item I give and bequeath to my three sons Benjamin, Richard & Robert Gassaway all my tract or parcel of land call'd Talbot's Resolution Manner containing 300 acres more or less, equally to be divided between them, each to have 100 acres, only my son Benjamin to have his first choyce after being divided, if either of my said sons, should die before they come of age of twenty one years, then to go to the survivour two mentioned, to be equally divided between them, or the whole to one if two should die before they come of age of 21 year's, to their or his heirs for ever.--
Item I appoint my wife Rachel Gassaway to be my whole executor of this my last will & testament, and after paying all my just debts, I give & Bequesath all my personal estate to my wife and children, hereafter nam'd viz: Thomas & James Gassaway, Hannah Porter, Mary Gassaway, & Lucy Nicholson, Benjamin, Sarah, Richard, Robert & Rachel Gassaway to be divided amongst them in such a manner as the law Directs for the distribution of the surplusage of Intestate Estates.--
Item I further Impower & appoint my Executor to pay of my aforesaid children their parts as shall be by division fall to each of them, either in money or effects at apraisement to be the choice of the executor.
In testimony whereof I have here unto put my hand & seal this eighteen day of February in the year of our Lord God one thousand seven hundred and fifty seven.
Sign'd seal'd publish'd and declar'd to be his last will & testament In presence of us: John Dorsey (of John); William Jean; William Aldridge; & Caleb Dorsey son of John.
Came on the 21st day of April 1757, William Jean & William Aldridge two of the subscribing witnesses to the foregoing will & oath on the Holy Evangel of Almighty God that they saw the aforesaid testor sign & seal the foregoing will and doth publish pronounce & declare the aforegoing will as his last will & testament that at the time of his so doing he was to the best of their apprehension of sound & disposing mind & memory & that they severally subscribed their names as witnesses to the said will in the presence of the said testor & at his request. sworn before Benjamin Tucker; on the 17th day of May 1757.
John Dorsey (of John) one of the subscribing witnesses to this foregoing will made oath on the holy evangel of Almighty God that he saw the before named testor Nicholas Gassaway . sign seal & publish pronounce & declare the aforegoing to be his last will & testament that at the time of his so doing he was to the best of his apprehension of a sound & disposing mind & that he subscribed his name as witnesses thereto in the presence of the said testor & at his request. sworn to before M Macnamara Dom Ex AA Co ty.
