Notes for Priscilla Ann Duvall
Will of Priscilla A Duvall, deceased
In the name of the beneuevalent father of all: I Priscilla Ann Duvall of York Township, Belmont County Ohio do make and probate this my last will and testament.
First it is my will that my just debts and all other charges be paid out of my state
Second I give and devise to my beloved sisters Rachel H. and Lynda R. Duvall the undivided one third of eighty two acres more or less of land in York Township Belmont County Ohio, known as the land on which Cornelious Griffen now resides during their natural lives and at their deaths it is my devise and will that John and Cornelius A. Griffen have my interest in the said land by them paying Mary A Amblers children or as many of them as are living at the death of my two sisters like sum of twenty five dollars each within nine years after the death of my two sister as above named
Third I give and devise to my nephew John Griffen one feather bed; pillows and bolsters have the same at my death.
Fourth I give and devise to my beloved two sisters above named all my personal property including house hold and kitchen furniture and wearing apparel during their natural lives and at their deaths it is my will and devise that so much of the bed and bedding table clothes and other apparel as is unconsumed at the death of the two sister above named to be equally divided between my four nieces if living at the time the death of my two sisters above named, Susan E Norris, Mary E Griffen daughter of Sarah E. Griffen, Mary L. Griffen Daughter of Elizabeth Griffen and Frerra Leotate Ambler daughter of Mary A Ambler and it is my will and devise that the residue of my personal property unconsumed at the death of my two sister above named be sold and the money be equally divided among all the living children of Mary A Ambler. I do hereby revoke all former wills made by me.
In testimony here I have hereunto set my hand and seal this 11th day of September AD 1879 Priscilla A Duvall Signed and acknowledged by said Priscilla A Duvall as her last will and testament in our presence and signed by us in her presence. Jay A Griffen
Be it remembered. That hereto fore to wit on the 8th day of november1879 the following testimony to the will of Priscilla A Duvall deceased was heard herein in words and figures following to wit. James A Griffen, being duly sworn and examined as a witness in the above entitled matter says I was present at the execution of the instrument now shown to me bearing date the 11th day of September 1879 and offered for probate as the last will and testament of Priscilla A Duvall late of York Township in said County of Belmont sealed and saw the said Priscilla A Duvall, now deceased signed said instrument and heard her acknowledge the same to be her last will and testament's and I therefore at her request and in her presence subscribed my name to the same as a witness. The said deceased at the tome of so executing said instrument was upwards of 46 years of age and was of sound mind and memory and not under any restraint

Samuel D Myers being duly sworn and examined as a witness in the above entitled matter says I was present at the execution of the instrument now shown to me bearing date the 11th day of September 1879 and offered for probate as the last will and testament of Priscilla A Duvall late of York Township in said County of Belmont sealed and saw the said Priscilla A Duvall, now deceased signed said instrument and heard her acknowledge the same to be her last will and testament's and I therefore at her request and in her presence subscribed my name to the same as a witness. The said deceased at the tome of so executing said instrument was upwards of 46 years of age and was of sound mind and memory and not under any restraint

And afterwards to wit on the same day the following proceeding were had in this court and entered on the Journal thereof in words and figures following to wit In the matter of the will (November 8th 1879 Of Priscilla A Duvall deceased) Will Produced This day an instrument of writing, purposing to be the last will and testament of Priscilla A. Duvall late of York Township in this county deceased was produced in open court for probate and it appearing to the court that the said will had not been deposited in this court and that due notice thereof and of the application to admit the same to probate and recend be given to Daniel Duvall, Rachel Duvall, Elizabeth Griffen, Susan Graligny, Elizabeth Fadden, Rachel A Rodabaugh, Edward Duvall, Susanna E Norris, CH Griffen, Lynda R Duvall. Frena L Ambler, Leonidas Ambler, Tappan Ambler, Mytal Ambler, Allen C Cordell, Charles Cordell, Louella Cordell, Thomas Cordell, Winfield Cordell, Baby Cordell, Benjamin Duvall, John Duvall and Mary E. Griffen next of kin of the testor resident of the state of Ohio that the said application will be for hearing before this court on the 22nd day of November at 10o'clock am

And afterwards to wit on the third day of December AD 1879 the finding and order of this court relative to the last will and testament of Pricilla A Duvall deceased were entire on the journal in words and figures following to wit: in the matter of the Will (December 2nd AD 1879 Of Priscilla A Duvall deceased) Will Proven Be it remembered That heretofore to wit on the 8th day of November AD 1879 an Instrument of writing purporting as be the last will and testament of Priscilla A Duvall late of York Township in this Co., deceased was produced in open court for probate and was then filed and it now being shown to the satisfaction of the court that due notice of the filing of said will and of the application to admit the same to probate and record in this court has been given to all of the next of kin of the testor pursuant to a few order of this court and James A Griffen and Samuel D Myers the subscribing witnesses to the said will which testimony was reduced to writing by them respectively subscribing filed with said will. Whereupon the court finds that the aforesaid ----- of writing is the last will and testament of the said Priscilla A Duvall deceased that the same was duly executed and attested and that the said Testatrix at the time of signing the same was of lawful age of ------ and disposing mind and memory and under no undue or unlawful restraint whatsoever. It is therefore by the court ordered that the said will be admitted to probate and that the same together with the testimony of the witnesses above named be entered of record in this court Thomas Cochran Probate Judge The State of Ohio, Belmont County SS I Thomas Cochrean Probate Judge within and for said county do by certify the foregoing to be full true and correct record of the last will and testament of Priscilla A Duvall deceased, heretofore filed probated and recorded in this office Thomas Cochran Probate Judge
