On Sept 8 and 9, 1896, in three separate petitions, Napoleon filed applications with the Dawes Commission for enrollment of his family as citizens by blood of the Choctaw Nation, naming the following persons: Napoleon B. Brashears, La Fayette Brashears, Arthur Brashears, Fred S. Brashears, Sarah E. Salmon, John C. Salmon, Forney (?Fannie) Salmon, Lois Salmon, Ida May Duncan, Dora M. Duncan, and for enrollment of the following as intermarried citizens of the Choctaw Nation: Mary J. Brashears and Ollie Duncan. The petition identifies all but Napoleon as children and grandchildren of Napoleon B. Brashears, who stated that he was entitled to enrollment for the following reason: "My father, Mortimer M. Brashears, was a son of Joseph Brashears, whose father was Zadock Brashears. All these Brashears were Choctaw Indians." Affidavits of James D. Coyle and Lucy J. Jones were attached, affirming "Napoleon B. Brashears is a son of Mortimer M. Brashears, and the said Joseph Brashears was a son of Zadoc Brashears. The above-named Brashears were Choctaw Indians." Napoleon was simply bald-facedly lying, for his "evidence" simply doesn't square with the documents; the Zadock Brashears he names as great-grandfather would have to have a grandson by the time he was 9 years old! Napoleon was trying to gobble up a piece of the Choctaw pie.
