Came to America prior to April 1, 1684. In April, 1684, the Rappahannock Court recognized a headright claim by Cadwallader Jones for the transportation of 24 men from England. Included in the list were Andrew Harrison and John Battaile. This 1684 claim is the first record of either man in Virginia. Both were freemen, with no headright restrictions or limitations.
At the time of his death, he was Lt. Col. of the Essex Militia. He married first, Catherine Taliaferro, daughter of Robert. He married second, Elizabeth Smith, daughter of Major Lawrence Smith and sister of Sarah, the wife of Col. John Taliaferro, the ranger. Elizabeth was the mother of all of his children.
Elizabeth, who married Captain John Battaile, of St. Mary's Parish, Essex County. In Essex records Lawrence Smith makes a deed to his "son-in-law" Capt. John Battaile, 16 June, 1700. Also recorded in February, 1708-09, guardian's bond of Augustine Smith, in behalf of "Lawrence Battaile, grandson of Major Lawrence Smith." The will of Captain John Battaile, dated 20th January, 1708 and proved 10th February, 1709, names Elizabeth, sons John Lawrence, Hay and Nicholas Battaile, after various devises, gives residue to be equally divided between his wife and son John, when his wife marries or son comes of age; witnessed by Captain John Catlett, Mr. Francis Taliaferro and Mr. James Harrison; mentions also "Brother Charles Taliaferro," and Mr. William Thornton.
